Terms of Service

This document is a general template provided for transparency and should be reviewed by qualified legal counsel before being relied upon.

These Terms of Service ("Terms") govern your access to and use of the Castinar platform at castinar.com(the "Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Castinar provides tools to run live webinars and autowebinars, stream and restream to external platforms, capture registrations, engage audiences (chat, polls, offers), and related features. We may add, change or remove features over time.

2. Accounts & eligibility

• You must provide accurate registration information and keep it up to date.
• You are responsible for safeguarding your credentials and for all activity under your account.
• You must be at least 16 years old and able to form a binding contract.

3. Acceptable use

You agree not to:

• Use the Service for unlawful, infringing, deceptive or harmful content or activity.
• Stream or distribute content you do not have the rights to, or that violates others' rights.
• Attempt to disrupt, reverse engineer, overload, or gain unauthorized access to the Service.
• Use the Service to send spam or to violate the terms of connected third-party platforms.

4. Payments & billing

Paid features (including wallet top-ups and usage-based/metered charges) are billed through our payment providers. You authorize us and our providers to charge the applicable amounts. Except where required by law, fees are non-refundable. Prices and billing parameters may change with notice.

5. Third-party platforms & restreaming

The Service lets you connect and stream to third-party platforms (e.g. YouTube, Facebook). Your use of those platforms is governed by their own terms and policies — for YouTube, the YouTube Terms of Service. You are responsible for holding the necessary rights and for complying with each platform's rules for the content you broadcast through them.

6. Content & intellectual property

You retain ownership of the content you upload or broadcast. You grant Castinar the limited rights needed to host, process, transmit and display your content to operate the Service. The Castinar platform, software and branding remain our property.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that third-party integrations (which depend on external providers) will always be available.

8. Limitation of liability

To the maximum extent permitted by law, Castinar will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our aggregate liability for any claim relating to the Service is limited to the amounts you paid us in the 12 months preceding the claim.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or where required to protect the Service or other users. Provisions that by their nature should survive termination (e.g. IP, disclaimers, liability) will survive.

10. Governing law

These Terms are governed by the laws of Poland, and disputes are subject to the competent courts of Poland, unless mandatory consumer-protection law provides otherwise.

11. Changes

We may update these Terms from time to time. We will revise the "Last updated" date and, for material changes, take reasonable steps to notify you. Continued use after changes take effect constitutes acceptance.
